Terms of Service

By engaging Switchenter for services or using this website, you agree to these terms. If you do not agree, please do not use our services.

Switchenter provides custom business system design, development, and ongoing managed-service operation ("Care Plan") for businesses. The scope, deliverables, timeline, and pricing for each engagement are agreed upon in a separate written agreement before work begins.

Upon final payment of the Setup Fee, you own the code, data, and infrastructure of your system outright. Switchenter retains no license or claim over your system after delivery. We may reference the engagement type (not details) in our portfolio unless you request otherwise.

The monthly Care Plan is an optional ongoing service agreement. It does not constitute ownership or rent of your system — you own it regardless. The Care Plan may be cancelled at any time with 30 days notice. Upon cancellation, Switchenter will provide a clean handover of all code, credentials, and documentation.

Setup Fees are invoiced in two parts: at project kickoff and at launch. Care Plan fees are billed monthly. All fees are non-refundable after work has begun on that phase, except in cases of material breach by Switchenter.

Switchenter is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the delivered system, including but not limited to lost revenue or data. Our total liability is capped at the fees paid in the preceding 3 months.

These terms are governed by the laws of India. Disputes will be resolved through good-faith negotiation first, then binding arbitration if needed.

We may update these terms from time to time. Material changes will be communicated via email to active Care Plan clients. Continued use of services after changes constitutes acceptance.
